Echo VPN User Service Agreement

Echo VPN and its affiliated R&D company (GalaxNet Inc., hereinafter referred to as GalaxNet) hereby specifically remind users to carefully read the terms of this agreement (minors should read it accompanied by their legal guardians). You have the right to accept or not accept this “Agreement”. Unless you agree to and accept all the terms in this “Agreement”, you have no right to download, install or use the “Echo VPN” software (hereinafter referred to as “Echo VPN” or this software) and its related services. Your downloading, installation or use of this software and its related services will be deemed as acceptance of this agreement and you agree to be bound by the terms of this “Agreement”. This “Agreement” is about the rights and obligations between GalaxNet and you regarding the licensed use of Echo VPN and related aspects. “User” or “you” refers to an individual or a single entity that has obtained the authorization and license of the “Echo VPN” software product and account through number registration, mobile phone number binding, etc.

Intellectual Property Statement

This software is developed by GalaxNet. All intellectual property rights such as trademarks and copyrights of the software, as well as all information content related to the software, including but not limited to: text expressions and their combinations, icons, graphics, charts, colors, interface design, layout framework, related data, printed materials or electronic documents are protected by copyright laws and international copyright treaties and other intellectual property laws and regulations.

Software Licensing Scope

1. Users can install, use, display, and run this software on computers and mobile phones (hereinafter collectively referred to as computers) (for the same account, it supports simultaneous online use and operation between computers and mobile phones).

2. Reservation of rights: All other rights not expressly authorized are still owned by GalaxNet. Users must obtain separate written consent from GalaxNet when using other rights.

3. Except as otherwise expressly provided in this “Agreement”, this “Agreement” does not provide for the relevant service terms for other services of GalaxNet website, APP or cooperative units accepted through this software. These services may be regulated by separate service terms. Please understand and confirm them separately when using the relevant services. If the user accepts the service, it is deemed to have accepted the relevant service terms.

About User Information

1. Users should register true, complete and correct personal information. True and complete user information will be the basis for GalaxNet to provide after-sales service and the premise for users to obtain legal protection.

2. If the user fails to fill in true, complete and correct personal information, the user shall bear all losses and responsibilities arising therefrom, including but not limited to: loss of account password, account disputes with others, etc.

User Instructions

1. Users should ensure that the information provided when registering for an Echo VPN software account or using the services provided by cooperative units is true, complete and correct, and bear corresponding legal responsibilities for the information provided.

2. Echo VPN account: (1) The ownership of the Echo VPN account belongs to GalaxNet. After the user completes the registration application procedures, he/she obtains the right to use the account. GalaxNet grants the user a non-exclusive right to use based on this agreement. This non-exclusive right to use is a temporary, revocable right to use within the scope of this agreement. (2) The right to use the Echo VPN account only belongs to the initial applicant for registration. In order to protect user information and account security, users are prohibited from giving, transferring, leasing or sharing accounts. If GalaxNet finds that the user is not the initial registrant of the account, GalaxNet has the right to recover the account without prior notice to the user, and all losses caused thereby shall be borne by the user. All disputes and losses caused by the user’s private gift, transfer, lease or sharing (whether for a fee or free of charge) of the account shall be borne by the user. At the same time, GalaxNet reserves the right to pursue legal responsibility for users who violate this agreement. (3) If there is a dispute between users over the ownership of the right to use the account, GalaxNet will make an independent judgment based on the initial personal registration information. If the true owner cannot be determined due to defects in personal data (untrue, incomplete, etc.), GalaxNet has the right to recover the disputed account, and the resulting losses shall be borne by the user. (4) Once the virtual products related to Echo VPN are sold, it means that you have accepted the services of GalaxNet, and the company does not accept any unreasonable refund requests. The refund amount will be deducted according to the length of service provided by Echo VPN to you. (5) The user shall be responsible for the safekeeping of the Echo VPN account and password, and shall be fully responsible for all activities under his/her account and password. (6) If the user provides false registration identity information, commits acts that violate this agreement, publishes illegal information, commits acts that violate social morality, and other acts that violate laws and regulations, GalaxNet has the right to terminate all or part of the services provided to him/her without prior notice. At the same time, GalaxNet reserves the right to pursue legal responsibility for users who violate this agreement.

3. Since GalaxNet is the sole copyright owner of this software, it enjoys the right to lease this software in accordance with the law, that is, the right to provide users with paid licensed use. Users shall not directly or indirectly give, transfer, lease or share (whether for a fee or free of charge) Echo VPN software and related services (including free trial services). All disputes and losses caused by the user’s violation of the foregoing agreement shall be borne by the user. At the same time, GalaxNet reserves the right to pursue legal responsibility for users who violate this agreement.

4. Minors should learn how to use the Internet correctly and arrange their game time reasonably under the supervision and guidance of their parents or teachers. They should pay attention to distinguishing the difference between the network and reality, and avoid affecting their daily study and life due to addiction to online games.

5. If users find that this software has loopholes, BUGs, etc., they should promptly report them to GalaxNet customer service. If users use software loopholes, BUGs, etc. to seek improper benefits, GalaxNet has the right to take measures against the relevant accounts, including but not limited to sealing the account, recovering the improper gains, etc.

6. Automatic renewal service description (1) Automatic renewal can be cancelled at any time. If you need to cancel, please do so within 24 hours of the billing cycle. (2) If you need to cancel automatic renewal, you can turn off automatic renewal in the payment channel associated with your account. (3) After canceling the subscription, you can still use the user service during the paid subscription validity period.

User Prohibited Acts and Responsibilities

1. Users should use this software in accordance with this “Agreement” on the premise of complying with the law and this agreement. Users shall not perform acts including but not limited to the following: (1) Unauthorized change of the use of this software, such as for other downloads or uploads other than the game acceleration function through relevant technical means; through technical means, so that games that are not originally supported by Echo VPN can enjoy acceleration services; (2) Unauthorized reverse engineering, reverse assembly, reverse compilation, etc. of this software; (3) Unauthorized use, copying, modification, linking, reprinting, assembling, publishing, publishing, establishing mirror sites, and unauthorized development of derivative products, works, services, etc. related to the software for information related to this software. (4) Using this software to publish, transmit, disseminate, and store content that violates national laws, endangers national security, national unity, and social stability, or any improper, insulting, defamatory, obscene, violent, and any content that violates national laws and regulations. (5) Using this software to carry out any acts that endanger computer network security, including but not limited to: using unlicensed data or entering unlicensed servers/accounts; entering public computer networks or other people’s computer systems without permission and deleting, modifying, or adding stored information; attempting to probe, scan, or test the weaknesses of this software system or network or other acts that undermine network security without permission; attempting to interfere with or disrupt the normal operation of this software system or website, deliberately spreading malicious programs or viruses, and other acts that disrupt and interfere with normal network information services; forging TCP/IP data packet names or parts of names.

2. The use of this software must comply with relevant national laws and policies, etc., maintain national interests, protect national security, and comply with this agreement. For all responsibilities caused by the user’s illegal or violation of this agreement (including but not limited to making remarks, transmitting content, etc.), the user shall be fully responsible, and it has nothing to do with GalaxNet and its cooperative units. If it causes losses to GalaxNet and its cooperative units, GalaxNet and its cooperative units have the right to demand compensation from the user, and have the right to immediately stop providing services to them, retain relevant records, and reserve the right to cooperate with judicial organs to pursue legal responsibility.

Force Majeure and Other Disclaimers

1. The user understands and confirms that in the process of using Echo VPN, he may encounter risk factors such as force majeure, computer viruses or hacker attacks, user location, user shutdown, and any other technical, Internet, and communication line reasons, which may cause the product service to be interrupted. Force majeure refers to objective events that cannot be foreseen, cannot be overcome, and cannot be avoided and have a major impact on one or both parties, including but not limited to natural disasters such as floods, earthquakes, plagues, and storms, as well as social events such as wars, turmoil, and government actions. When the above situation occurs, GalaxNet will try its best to cooperate with relevant units in the first time to repair it in time, but GalaxNet and its cooperative units will not bear any responsibility for the losses caused to users or third parties.

2. The user understands and confirms that the company needs to regularly or irregularly inspect or maintain the Echo VPN software or related equipment. If the service is interrupted within a reasonable time due to such circumstances, GalaxNet does not need to bear any responsibility for this.

Change, Interruption, and Termination of Service

1. In view of the particularity of network services, if any of the following situations occurs, the user agrees that GalaxNet has the right to change, interrupt or terminate part or all of the services (including paid services) at any time without any responsibility to the user or any third party: (1) According to legal regulations, the user should submit true information, but the personal information provided by the user is untrue or inconsistent with the information at the time of registration and fails to provide reasonable proof; (2) The user violates relevant laws and regulations or the provisions of this agreement; (3) According to legal regulations or the requirements of the competent authority (4) For security reasons or other necessary circumstances

Dispute Resolution and Applicable Law

After the user downloads, installs or uses this software and its related services, if a dispute arises during the performance of this agreement or the use of its related service content, the user agrees to resolve the dispute in accordance with the relevant laws and regulations, and agrees to accept the jurisdiction of the people’s court where GalaxNet is located.
